In my opinion it shouldn't be, because both parties made the decision to drink, knowing it could influence their decision making. If a person has a few too many, gets drunk, and consents to having sex with someone, it was his/her choice to drink, so she/he has to live with the outcome. If someone gets drunk, and does something that they regret later, the fact that they were drunk isn't an exscuse.
